Waste Authority Loses Flow Control Fight

Hattiesburg, Miss. -- The Pine Belt Regional Solid Waste Authority has lost its hold on flow control laws that required solid waste to go to the authority’s landfill and three transfer stations. The Washington, D.C.-based National Solid Wastes Management Association and several of its members sued, alleging the local government’s laws violated the Commerce Clause. A federal district court in Mississippi agreed, applying the analysis used by the U.S. Supreme Court in the

decision from 1994.
